POCKET64 Terms of Service

These Terms of Service (the "Terms") govern your use of the POCKET64 web service (the "Service") provided by Bloom Studio Inc. (the "Operator"). By using the Service, you agree to these Terms.

1. Application of these Terms

  1. These Terms apply to all matters between you and the Operator relating to the Service.
  2. Explanations, notices, guidelines, and other rules displayed in the Service form part of these Terms.
  3. If these Terms conflict with a rule described above, that rule will control unless these Terms state otherwise.

2. The Service

  1. POCKET64 is a service that lets users play mini-games in a browser on a smartphone or other supported device, record scores, personal bests, XP, ranks, and medals, and use leaderboards and score-sharing features.
  2. You may play as a guest without registering. When you start a game, the Service may automatically create a guest account to associate scores with that browser session.
  3. Registered users ("Members") may participate in public leaderboards, retain results across sessions, and use other features made available to Members.
  4. The Service is currently provided free of charge. If the Operator introduces paid features, the Operator will display the price, payment terms, and other applicable conditions before purchase.

3. Eligibility and minors

  1. You may not use the Service if you are under 13 years old.
  2. If you are 13 or older but are a minor under the laws where you live, you must obtain consent from a parent or legal guardian before using the Service.
  3. If you use the Service on behalf of a business or other organization, you represent that you have authority to bind that organization to these Terms.

4. Guest use

  1. A guest account, scores, and personal bests depend on cookies and other browser storage. They may become inaccessible if you clear cookies or site data, end a private-browsing session, change devices or browsers, or allow the session to expire.
  2. A guest session may not transfer between storage environments even on the same device, such as between Safari and a web app added to the home screen.
  3. The Operator does not guarantee continued retention or recovery of guest data. Users who want continued access to their results should register as Members.

5. Registration and authentication

  1. Registration and authentication for the Service generally use a Google account. You must also comply with Google's applicable terms.
  2. You must use accurate authentication information that belongs to you and appropriately secure your account and devices.
  3. When a Google account is newly registered with POCKET64, the results associated with the guest account immediately preceding registration will be transferred to the new Member account.
  4. If you sign in to a Google account already registered with POCKET64, generally only the single run selected for saving immediately before sign-in will transfer. Other guest results will not transfer.
  5. If you become aware of unauthorized account use or a security issue, promptly contact the Operator under Section 18.

6. Display names and public information

  1. The Service may assign each user a display name made up of letters, numbers, hyphens, or underscores and may allow changes within limits set by the Operator.
  2. A Member's display name, game, score, position, rank, medal, and other information shown on a leaderboard or shared-score page may be publicly accessible on the internet.
  3. You may not use a display name that infringes another person's rights, impersonates another person, is discriminatory or obscene, or is otherwise reasonably considered inappropriate by the Operator.
  4. The Operator may change or hide a display name that violates this Section or restrict the related account.

7. Scores, leaderboards, and progression

  1. To prevent cheating and support fair play, the Service may replay a run on the server using in-game input events and other data to verify the score. The official recorded score will generally be the value verified or recalculated by the server.
  2. Only Members appear on leaderboards. Leaderboards may cover daily, weekly, all-time, or other periods and conditions set by the Operator.
  3. XP, ranks, medals, positions, and other indicators are entertainment-only records within the Service. They have no monetary, cryptocurrency, merchandise, prize, or other property value and may not be transferred, redeemed, or sold.
  4. The Operator may correct, recalculate, hide, or delete scores, positions, XP, ranks, medals, or leaderboard entries when reasonably necessary because of a bug, cheating, an aggregation error, a game-balance change, legal requirements, or operational needs.
  5. A run may fail to save because of a network interruption, browser closure, an extended pause, expiration of the validation period, or another technical reason.

8. Sharing

  1. You may share score URLs generated by the Service on X or another external service.
  2. A shared-score page may publicly display your display name, game, score, and rank. You are responsible for reviewing the displayed information and deciding whether to share it.
  3. Use of an external service is governed by that service's terms and privacy policy. The Operator is not responsible for display, redistribution, deletion, or use of information on an external service.

9. Prohibited conduct

You must not:

  1. violate applicable law, public policy, or these Terms;
  2. impersonate another person, misuse another person's account, or use false information;
  3. tamper with a score, input log, play ticket, network communication, or client program to submit or attempt to submit an illegitimate result;
  4. use bots, scripts, emulators, or other automated means to play, create accounts, submit scores, or make requests at scale;
  5. bypass, interfere with, or probe rate limits, authentication, signature verification, or other security or anti-cheating measures, except for security research authorized in advance in writing by the Operator;
  6. place an excessive load on, disrupt, or interfere with the Service or any third-party server, network, or system;
  7. exploit a vulnerability or transmit malware or other harmful code;
  8. infringe the intellectual property, privacy, reputation, or other rights or interests of the Operator or a third party;
  9. commercially exploit, resell, or redistribute the Service or information from the Service without the Operator's permission; or
  10. engage in other conduct the Operator reasonably determines threatens the safe, fair, or proper operation of the Service.

10. Enforcement

  1. If you breach these Terms, or if reasonably necessary to protect the safety, fairness, or operation of the Service, the Operator may, without prior notice, invalidate or delete scores, exclude you from leaderboards, restrict features, suspend or delete an account, or deny access.
  2. When there is no urgency and doing so would not compromise security or third-party rights, the Operator will, where reasonably practicable, explain the reason for an action and accept questions from the affected user.
  3. Except where required by law, the Operator is not required to restore deleted guest data, scores, or accounts.

11. Intellectual property

  1. Intellectual property rights in the software, games, images, designs, logos, text, audio, and other content making up the Service belong to the Operator or the applicable rights holder.
  2. Subject to these Terms, the Operator grants you a limited, non-exclusive, non-transferable, non-sublicensable right to use the Service for personal, non-commercial purposes.
  3. Except for the limited right expressly granted above, these Terms do not transfer to you any intellectual property right of the Operator or a third party.

12. Changes, suspension, and termination

  1. The Operator may change, add, or discontinue all or part of the Service, including games, rules, score calculations, leaderboards, and supported environments.
  2. The Operator may temporarily suspend all or part of the Service for maintenance, outages, security response, events beyond reasonable control, interruption of an external service, legal requirements, or other reasonable grounds.
  3. If the Operator terminates the Service, it will give advance notice by a reasonable method and with reasonable lead time, except in an emergency or when advance notice is impracticable.

13. Disclaimer of warranties

  1. The Operator does not warrant that the Service will always be available, free of errors, outages, or security vulnerabilities, work on a particular device or browser, or preserve scores or other data without loss.
  2. The Operator does not warrant the completeness, accuracy, timeliness, or fitness for a particular purpose of leaderboards, statistics, displayed information, or external links.
  3. Nothing in this Section or these Terms excludes or restricts a warranty, right, or liability that cannot lawfully be excluded or restricted.

14. Limitation of liability

  1. The Operator is not liable for damage that is not attributable to the Operator.
  2. If the Operator is liable for breach of contract or tort and the Operator has not acted intentionally or with gross negligence, its liability is limited to direct, actual, and ordinary damages arising from the relevant act and excludes lost profits and indirect, special, incidental, or consequential damages.
  3. The preceding paragraphs do not apply to the extent they would be invalid under Japan's Consumer Contract Act or other applicable law. They do not exclude or limit liability for the Operator's intentional misconduct or gross negligence.

15. Your responsibility

If your breach of these Terms or other conduct attributable to you causes damage to the Operator or a third party, you are responsible for that damage in accordance with applicable law.

16. Account deletion

  1. A Member may request deletion of an account by contacting the Operator under Section 18. The Operator will verify the requester's identity and respond in accordance with applicable law and the Privacy Policy.
  2. When an account is deleted, data associated with it—including scores, personal bests, XP, ranks, medals, and leaderboard entries—will become unavailable and generally cannot be restored.
  3. The Operator may retain information for as long as reasonably necessary to comply with law, resolve disputes, prevent abuse, or meet legitimate security needs.

17. Changes to these Terms

  1. The Operator may amend these Terms in accordance with applicable law when the amendment is in users' general interest or is reasonable in light of the need for the amendment, the appropriateness of the amended terms, and other relevant circumstances.
  2. The Operator will give advance notice of a material amendment, its effective date, and its content by posting it in the Service or by another reasonable method.
  3. If you use the Service after amended Terms take effect, the amended Terms apply except where applicable law requires otherwise.

19. Governing law, jurisdiction, and language

  1. These Terms are governed by and construed under the laws of Japan.
  2. Unless applicable law permits another venue, the Tokyo District Court will have exclusive jurisdiction as the court of first instance over disputes arising from or relating to the Service or these Terms.
  3. If the Japanese version of these Terms conflicts with a translation, the Japanese version controls to the extent permitted by applicable law.
